<br />'I} .~. <br /> <br />- _.,su'., <br />--= <br /> <br />Authorizes new well permits to be granted pursuant to a <br />replacement plan and adds new provisions to the law governing the <br />specifics of such plans. Requires such plans to be published within 60 <br />days after filing an application for such a plan. <br />With respect to appropriations of designated ground water from <br />the Dawson, Denver, Arapahoe, and Laramie-Fox Hills aquifers: Provides <br />for determinations of such rights; specifies that such a determination shall <br />be considered a final detennination subject to the ground water <br />commission's retained jurisdiction for adjusnnent of acre-feet amounts <br />based upon actual geophysical information from such wells; requires that <br />an application for a well permit must already have or shall be <br />accompanied by an application for a determination of such water; <br />specifies that a well permit can be issued pursuant to a determination <br />. ",ithout publication; specifies that, in order to grant a well permit if a <br />replacement plan would be needed to replace depletions to alluvial <br />aquifers, such plan shall be published unless one is already approved by <br />the ground water commission under a prior publication. Deletes <br />requirements for final permits for permits issued on or after July 1, 1991. . <br />Clarifies and reaffirms that a fee of $30 for late fJling of a <br />statement of beneficial use is not required if a permit was issued prior to <br />July 14, 1975. Authorizes the ground water commission to promulgate <br />rules to grant temporary approvals of permits ",ithout publication. <br />With respect to ground water commission hearings, specifies that <br />appeals of a hearing officer's decision shall be heard by the commission <br />at its regular or special meetings. Requires such hearings to be held <br />",ithin 180 days after receipt of a request therefor. <br />Specifies that publication costs for final permits will be paid by the <br />state engineer from the division of water resources ground water <br />management cash fund. Permits the ground water commission to <br />authorize applicants to pay publication expenses directly to newspapers <br />rather than to the commission. Imposes a $60 fee for requests to extend <br />the expiration date on a large capacity \vell permit. <br />Expands the authority of ground water management districts to <br />cover wells with a conditional permit as well as with a [mal permit. <br />Authorizes such districts to enforce violations by small capacity wells. <br />Removes the notification requirement to all water users within a ground <br />water management district by first class mail, but still requires notice by <br />publication. Requires such disoicts to hold hearings v,ithin 180 days after <br />a request therefor. <br />Appropriates $240,000 and 6.0 FTE from the division of water <br />resources ground water management cash fund to the division of water <br />resources for the implementation of the ground water statutes. <br /> <br />-- <br /> <br />. <br /> <br />. <br /> <br />, <br /> <br />-2- <br />
