11 OR lARAMIE-Fox HILLS AQUIFERS has been constructed in compliance
12 with subsection (I) of this secti()n, the applicant shall file a notice \vith
13 the commission of corrunencement of beneficial use on a form prescribed
. 14 by the commission 'W;thin thirty days after the first beneficial use of any
IS water withdrawn from such well.

16 (3) (a) (I) To the extent that the corrunission finds that water has
17 been put to a beneficial use and that the other terms of the conditional
18 pennit have been complied with and after publication of the information
19 required in the final permit. as provided in section 37-90-112, the
20 commission shall order the state engineer to issue a final pelmit to use
21 designated ground water, containing such limitations and conditions as

22 the corrunission deems necessary to prevent waste and to protect the
7~ rights of other appropriators. In determining the extent of beneficial use

24 for the purpose of issuing fmal permits, the commission may use the same
7- criteria for determining the amount of water used on each acre ".j',ich
