Forest Service Reserved Rights Cases, Case Nos. 81-CW-220 et al., Water Division 2.

We are very close to agreement on a stipulation allowing the Forest Service to withdraw the
Division 2 claims with prejudice, on conditions acceptable to the objectors. We're negotiating
over two sentences and are now waiting for the Forest Service to offer a counterproposal to our
last proposal. .

2. Forest Service Reserved Rights Cases, Case Nos. W-1146-73 et aI., Water Division 7.

The technical committee met on January 13, still discussing the Piedra River. The Forest
Service presented a proposal for the Piedra that was similar to its previous proposal and Jim
Dubois, the DOJ attorney handling the case, has proposed language for more gen~al decree
provisions. Another meeting of the full negotiating committee is scheduled for February 4 and 5.
The Board members may wish to discuss litigation and settlement strategy on these cases with
counsel in executive session.

.

1 Text concerning previously reported matters will usually contain only information on recent developments rather
than repeating background information.
