Ap'plication Summar:)'
This is an application for water rights and changes of water rights. Applicants have identified a
number of water rights previously decreed for several ditches or other structures (absolute as well
as conditional) on several streams tributary to Fish Creek and the Yampa River. Applicants
propose to add new uses to said decrees, including rights of exchange and substitution,
augmentation and replacement. Applicants request that the priority date for the additional uses of
each water right to remain the same as the original priority date of each water right. In the
meantime, Applicants propose two alternatives if the court declines to award the original priority
dates, one of which is a priority date of the date of filing of this application.

CWCB Appropriations
The Board has instream flow water rights in the majority of the streams identified in this
application. These streams are listed in Table I, below.

Potential for Iniury
The proposed chMges of water rights may constitute an expansion of use, thus reducing the
streamflows in the streams identified in the application. The new uses for each water right,
especially if granted original priority dates, could adversely affect the ISF water rights on the
subject streams.

Statements of opposition were also filed by: the TriState Generation and Transmission
Association and the Colorado River Water Conservation District.
