The CWCB currently holds instream <br />flow water rights on Cunningham Creek for 1.0 cfs (4/1 - 9/30) and 0.5 cfs (10/1 - 3/31), decreed in <br />Case No. 5-73W195l, beginning at the Fryingpan-Arkansas diversion and extending downstream to <br />the confluence with the North Fork of the Fryingpan River, a distance of approximately 3.2 miles, <br />and on Middle Cunningham Creek for 1.0 cfs (4/1 - 9/30) and 0.5 cfs (10/1 - 3/31) decreed in Case <br />No. 5-73Wl957, beginning at the Fryingpan-Arkansas Diversion and extending downstream to the <br />confluence with Cunningham Creek, a distance of approximately 0.5 miles. <br /> <br />The CDOW plans to eradicate non-native fish in Cunningham Creek without using chemicals, and <br />will ask the Board to consent to a temporary flow reduction below the Board's decreed instream <br />flow amounts as a means to achieve this.
