In addition, at the November 21, 2001 Board Meeting, the Board <br />adopted the "Easement Guidelines for the Chatfield Downstream Channel Improvement Project" dated <br />November 2001. The Colorado Water Conservation Board entered into a contract with South Suburban <br />Parks and Recreation District (District) on May 5, 1997 for the implementation of certain Public <br />Recreational Facilities within the Project Recreational Lands. <br />The Staff has received a request from the District by a Power Point presentation and submittal dated <br />August 31, 2004. The District is submitting their request under contract provision no. 7 page 4 of said <br />contract dated May 5,1997. <br />If this request is approved, it will provide the District the ability to construct a gravel walking/trail along <br />the entire length of Reach No.2, which is located in the South Platte River floodplain in Littleton, <br />Colorado and outside of the limits of the 100- year floodplain. <br /> <br />Discussion <br />Provision no, 7 page 4 of said contract states: "The Grantee (District) may construct additional public <br />recreational facilities only after submitting plans and specifications for such facilities to the Grantor <br />(Board) and obtaining Grantor's written approval. The Grantee must construct such facilities in <br />accordance with the plans and specifications approved by the Grantor and must submit as-built <br />drawings of such facilities to the Grantor upon completion. The Grantor agrees that the Grantee may <br />construct or temporary special events, and public art pieces without submitting plans and specifications <br />or obtaining the Grantor's written approval, provided that such maintenance of the Project. All public <br />art pieces installed by the Grantee shall be located fIjieen feet from the top of the channel slope and ten <br />feet from the edge of the multi-use trail. <br /> <br />Flood Protection.
