July or the' September meeting, or perhaps even longer than that. I
think that would be pure guess. I am not asking that we stop the
action. I am simply saying let's wait.for a minute and see if there
are some more results, and we can take ~ction on it at a later date; I
think with no harm.

MR. SHERMAN: Which court is this matter pending in?

MR. ADKINS: It's in the U. S. District Court of New'Mexico.

MR. STAPLETON: Is there any objection from the members of the Board
to deleting this and to keep it in front of us? It will be on the next
minimum stream flow recommendation we have. If'ioU want to ask that it
be deleted again, that will be fine. But we won t lose ttackof it that
way.

MR. SHERMAN: I would like to' hear from Mr. . Kochman on that. Is there
any objection from the Division of Wildlife?'

MR. KOCHMAN: Mr. Adkins had some discussion earlier, or the later part
of last' week, with one of our managers; Ed Kringle from Colorado Springs
and eventually it went through the administrative staff of the Division
of Wildlife. It is their feeling that they would like to see-it acted
on~at this Board meeting. .

But I think it's also.pretty apparent' that the Division of Wildlife's
concerned and realizing what's at stake withCF&I, and realizing the
responsibilities of the Board.

It's the position of the Division of Wildlife that Ricardo Creek still
remain before the Board and they are hoping that action ,is taken at.
this time. . But still recognizing that the Board and the other respon-
sibilities . that concern CF&I, it is still their decision at this time .'
It is our. objective that a flow be maintained in Ricardo Creek. And-
how that's done, whether it's with a decree right.now or some time in
the future, the important thing is that a fishery be maintained in
Ricardo Creek. But we also recognize some of the other complications
involved.

I

,:,'26.;.
