<br />(i~ <br /> <br />. <br /> <br />, <br /> <br />. <br /> <br />. <br /> <br />North and South Platte Rivers <br /> <br />We have been participating in the Nebraska vs. Wyoming settlement negotiations. The <br />two states have agreed to stay litigation and to make a good faith effort to resolve their <br />differences. Our primary concerns involve resolving the environmental issues on the <br />Lower Platte River in Nebraska, and avoiding further demands on Colorado above those <br />required in the South Platte Compact and the Supreme Court stipulation concerning the <br />North Platte. <br /> <br />Gunnison River <br /> <br />The water court in Division 4 has ruled on Motions concerning questions of law in the <br />Arapaho County cases (Union Park). Additional details as to the ruling will be provided <br />by the Attorney General's Office. <br /> <br />Rio Blanco <br /> <br />The Rio Blanco Habitat Restoration Project has received approval for a $96,000 grant <br />from the Colorado Department of Public Health and Environment, which is being matched <br />by financial and in-kind contributions from the San Juan Water Conservancy District, the <br />Southwestern Water Conservation District, the Lower Blanco Property Owners <br />Association, the Colorado Division of Wildlife and the Colorado Water Conservation <br />Board. The restoration project involves streambank and channel work designed to <br />improve water quality and the fishery in the Lower Rio Blanco. Project construction is <br />scheduled for summer 1997. Efforts to obtain project permits, stockpile materials, and <br />acquire land and water rights are ongoing. As part of the Board's $14,000 in-kind <br />commitment to the project, Dan Merriman and Kathleen Klein will continue to provide <br />project coordination and public education services over the coming year. <br /> <br />Colorado Water and Power Authority <br /> <br />In March of 1990, the CWCB and the Water & Power Authority concluded a <br />Memorandum of Understanding with regard to the statutory authorities of the two <br />agencies. The MOU deals primarily with the conduct of planning studies and coordination <br />of lending activities between the two agencies. Under Paragraph 5 of the MOU, the <br />Board staff has been referring all requests for municipal water project funding to the <br />Authority to request a determination as to whether a project might be eligible for bond <br />financing under the Authority's Small Water Resources Projects Financing Program before <br />the project is recommended to you. <br /> <br />Since 1990, the Authority has established its Drinking Water Revolving Fund which was <br />not contemplated in the MOU. We believe it would be appropriate now to review the <br />MOU in light of this and possibly other changes that have taken place in the last several <br />
