(6:02 - 6:06 p.m.) <br /> <br />Lochhead was recused from participation in items 27e and 27f. Anne Janicki, CWCB <br />staff; introduced the proposed stipulation that recognizes the change of water right <br />claimed in the original application as senior to the Board's appropriation and requires <br />that diversions claimed in the amendment be subject to the Board's instream flow <br />appropriation on the Fraser River. A motion was made by Meyring and seconded by <br />Eisel to approve the staff recommendation to ratify the statement of opposition filed <br />in this case and to approve the proposed stipulation with Horn Ranches to protect the <br />Board's instream flow water rightS. The motion passed by l)nllnimous (6-0) decision <br />with one abstention. <br /> <br />27f. Stipulation: S-91CW173; Lane (6:06 - 6:08 p.m.) <br /> <br />Anne Janicki, CWCB staff; introduced the proposed stipulation that requires the <br />applicant to curtail diversions under senior water rights which they also own to offset <br />the full amount of the junior diversions into their pond and to limit diversions under <br />the junior right to times when the senior rights would be physically and legally <br />available. Jennifer Gimbel, AG staff, commented on a change in the stipulation. A .~, <br />motion was made by Eisel and seconded by Smith to approve the staff <br />recommendation to ratify the stipulation with Lane to protect the Board's instream <br />flow water rights. The motion passed by nn"nimaus (lMl) decision with one abstention. <br /> <br />27g. Stipulation: S-91CW202; Purdy & Kell. (6:08 - 6:10 p.m.) <br /> <br />Anne Janicki, CWCB staff, introduced the proposed stipulation that requires the <br />applicant to include the terms and conditions of the CWCB/Vidler Agreement in their <br />decree and identifies the junior date for arlmini~tration of the exchange. A motion was <br />made by Lochhead and seconded by Eisel to approve the staff reco=endation to <br />ratify the stipulation with Purdy and Keil to protect the Board's instream flow water <br />rights. The motion passed by nn'lnimous (7-0) decision. <br /> <br />28. Instream Flow Program: Withdrawal of Statement of Opposition (deleted) <br /> <br />31.
