<br />I think that at this point in time the River District's position is <br />that we are not sure how a scientifically objective minimum stream flow <br />is arrived at. We do have one of our consultants working on this <br />question. We have been in touch with not only our engineering consul- <br />tants, but our environmental consultants on this matter to try to deter- <br />mine how these minimum stream flows are objectively and scientifically <br />arrived at to keep the fish alive. We are not sure how the aesthetics <br />are arrived at. At this point in time, the River District does reserve 1 <br />its right to file a protest under the existing water law to minimum <br />stream flows as they might be filed in western slope streams if the <br />River District feels that the methods used to arrive at those minimum <br />stream flows are not scientifically objective. <br /> <br />Mr. Barrows: You are hiring consultants and biologists to assist our <br />biologists, did I understand you correctly? <br /> <br />Mr. Rolly Fischer: I think we are going to do it from both sides, Pete. <br />At this stage, we do not have any viable data, but we do have a biologist <br />who we are working with in this regard and that work is being done <br />through our consulting engineer. And I just don't know what we are <br />going to come up with. <br /> <br />Mr. Barrows: I guess my point is that we have 500 professional biologists <br />and you have one. If you had 500 hydrologists, I think we would defer <br />to you in one area and possibly you to us in the other. <br /> <br />Mr. ROlla Fischer: I think your comment is quite well taken and should <br />be consi ered by the River District Board. We have already consulted <br />with two Division of Wildlife experts and - No, I wouldn't really say <br />we got two opinions, the one supplemented the other. I think our <br />responsibility in this matter in relationship to the River District <br />Board is to try to determine what our position is and that includes <br />consultation with we hope only one or two of your 500 biologists. I <br />really don't need 500 Division of Wildlife biologists in my office. <br /> <br />Mr. Vandemoer: Rolly, I have a question. Do you have your sheet there? <br />, Is there any irrigation water in any of these Roaring Fork applications? <br /> <br />Mr. Fischer: Are you talking about the Crystal River? <br /> <br />Mr. Vandemoer: I am talking about this whole list I have here. <br /> <br />Mr. Fischer: Sure. <br /> <br />Mr. Vandemoer: I see you have several reaches here and it is a little 1 <br />hard to sit here and look at graphs to see whether there is irrigation <br />or not. I have said in other cases and I say again that I am for these <br />until there is irrigation and if there is irrigation, I don't think <br />we ought to approve them. ' <br /> <br />Mr. Fischer: We have to go to the GS maps and to the Water Division <br />commissioners to determine that question. At this point in time if <br />my memory is right, and as I get older I trust it less, that between <br />the two stations on the Crystal there is at least one headgate diver- <br />sion and below the last one there are major headgate diversions. <br /> <br />-23- <br />
