<br />Mr. Stapleton: Are there any further questions or conunents on the <br />Cache La Poudre minimum stream flow? <br /> <br />Mr. Kochman: My name is Eddie Kochman. I am also with the Division of <br />Wildlife. Listening to this very massive amount of information is very <br />interesting. We think we have a pretty important resource on the Poudre, <br />too. I am certain that all these gentlemen also agree with that and so <br />does the board. I always like to think that when we have an opportunity 1 <br />for mutual dialogue there is always some mutual solution. <br /> <br />Last summer we had a pretty bad experience on the Paudre. It so <br />happened that the Greeley diversion took enough water that they dried <br />up the Poudre. There was no word to the division that this was even <br />going to happen until the phone calls started coming 10 and the fish <br />started dying. And believe it or not, we still haven't develoved a <br />trout that knows how to walk~ Well, right or wrong, this wasn t good <br />for us, it wasn't good for the irrigators. And you talk about public <br />response, there was some public response. There were people that <br />wanted lawsuits. There were two extremes. <br /> <br />Very briefly, we have a problem on the Poudre. It represents one of the <br />finest fisheries on the eastern slope. When the division filed on this <br />water we knew that a series of exchanges were occurring. As we under- <br />stand the intent of Senate Bill 97, it also allows the division to <br />enter into exchanges. We thought getting a decree was the first step. <br />The next step would be in trying to get exchanges to assure a flow <br />primarily below the Greeley diversion. Now, I don't know if this is <br />the correct thinking or not, but it is thinking that we have been led <br />to believe was valid. If we have to sit down and discuss this more, <br />the division is certainly willing to do that, but I hope the reaction <br />isn't such that the problem is unsolvable. Fort Collins talks about a <br />green belt program. The question was asked if we were involved in <br />other considerations besides just fish. Fort Collins is a very unique <br />town in having a river like the Poudre flowing through it. It will not <br />look too good without any water in it. <br /> <br />My final statement is if we have to sit down and look at this thing I <br />still see where Senate Bill 97 is applicable. I think exchanges can <br />be arranged thi.tmeet the flow reqt:irements without detriment to any <br />individual. <br /> <br />Mr. Moses: To my knowledge, this is the first time that the board has <br />had a situation where exchanges have previously been practiced and which <br />would be impeded by or complicated by minimum flow requirements. I am <br />impressed by the complexity of the map which Mr. Fischer gave me. <br />Living in the Boulder area, I know how vital exchanges are to the full <br />utilization of the waters of Boulder Creek. <br /> <br />1 <br /> <br />I am also impressed with what the last speaker said. I think it wou+d <br />be helpful if representatives of the Division of Wildlife could sit <br />down with the water users to see if they could work out some plan of <br />operation if the Division is satisfied that it can do it without inter- <br />fering with the exchanges. <br /> <br />-21- <br />
