our staff and the Fish and Wildlife Service and
is concerned, we will review all these figures.
promise without compromising the purpose of the
attempt to do so.

the Division of wildlife
As much as we can com-
appropriations, we will

I want 'to emphasize--and I'm sure, Bob, you and your people on the Denver
Water Board ar~ very well aware of the fact~-that it is critical that
all parties 'be brought in harmony in ,order that'you can'mov~:for~ard.'
The fact that, the federal agencies are in this act is not the fault of
this board. We didn't invite th~ in, but they are in, nevertheless.

I

Again, we are in the very unhappy position of trying to be a mediator
between conflicting interests at both the state and federal levels.
We have a lot 'of people in this state involved in, addition to the federal
agencies. We will do the best we can. '

MR. SHERMAN: If we defer on this matter at this meeting, does that mean
we would only be able to 'take preliminary action at the next meeting,
followed by final action in May?

MR. STAPLETON: Yes.

MR. SHERMAN: I just wondered, dOes it, from the standpoint of resolving
this controversy,' hurt us to :take preliminary action today or for the
Board at least to agree that we could take final action in March, as
opposed to preliminary action at that time?

.
MR. STAPLETON: Well, Mr. Sherman, I think that in terms of getting the
Denver Water Board to negotiate on the basis that no approval at this
time might be more advantageous in terms of negotiation, I ,don't think
it makes any difference, as I understand it, whether ~e approve it
finally on March 14"or~on':May 18 so far as the decree would be concerned.
I am anxious to get the report circulated and consid~red by all parties,
and I would personally prefer that we have no. preliminary approval that
might be 'some precedent one way Or the other on final approval. We
may have to make tha~ decision in March, but I personally prefer not to--
but that is up to the Board.

MR. ,SHERMAN: Mr. Sparks, by deferring the matter until the next meeting,
would that in any way adversely affect the filing by the Board?

MR. SPARKS: No, it would not. We would still get the same priority
date.

MR. STAPLETON: I will entertain any kind of motion you want on pre-
liminary approval.

I

MR. THOMSON: Can we speak to the preliminary?

MR. STAPLETON: Yes.

MR. THOMSON: I'm not going to ask for deferment, but on pages 1 and 2,
those items related to Lake and Chaffee Counties, we did not receive our
copy of this until about a week ago. I'm sure that is because of the

-20-
