Our clients have requested that we present their concerns regarding the Board's <br />proposed consideration ofinstream flow appropriations in the San Miguel River and three <br />of its tributaries: Prospect Creek, Turkey Creek and Vance Creek. Telluride and the <br />MVMD both own significant water rights that could be injured if the Board appropriates <br />additional flows within these streams. <br /> <br />I. SAN MIGUEL RIVER MAINSTEM NEAR TIlE TOWN OF TELLURIDE <br /> <br />. As you know, Telluride and the MVMD have maintained a dialogue INith the CWCB <br />.regarding instream flows in the segments now under consideration for several years. In <br />past years, instream appropriations of 9.0 c.f.s. (in addition to the CWCB's existing 6.5 d.s. <br />flow) have been suggested for these segments. The CWCB has again listed the San Miguel <br />and various tributaries for consideration of instream flow appropriations in 2002. The <br />CWCB priority list indicates that the impetus for appropriating additional flows in these <br />
