Stream and Lake Protection Section - Authorization to Proceed to Trial - Case N. 4- <br />02CW38; Upper Gunnison River Water Conservancy District <br />Tape 3, Track 1 3:10:00 - 3:13:00 <br />Action: A motion was made by Don Schwindt with a second by Ray Wright for staff <br />recommendation that the Board authorize the staff to proceed to trial to defend <br />the Board's findings and recommendations and to assure compliance with <br />Senate Bill 216. The Staff is open to discussing settlement with the <br />Applicant, and will discuss with the Board with any settlement proposals that <br />are offered to the Board prior to the July 2003 Board meeting. <br /> <br />The motion was approved 7-0. David Smith and Harold Miskel were not <br />present in the room. Carolyn McIntosh was not present. <br /> <br />23. Stream and Lake Protection Section - Request for Approval of Enforcement <br />Agreement - Case No. 4W 437; NPS Quantification of Black Canyon Reserved Right <br />Tape 3, Track 1 3:13:00 - 3:38:30 <br />Action: A motion was made by Greg Hoskin with a second by Keith Catlin for Staff <br />recommendation of the attached Memorandum of Agreement (MOA). <br /> <br />The motion was approved 9-0. Carolyn McIntosh was not present. <br /> <br />24. Stream and Lake Protection Section - Contested Instream Plow Recommendation <br />Water Division 4 <br />Tape 3, Track 1 3:38:30 - 3:49:20 <br />Action: A motion was made by Harold Miskel with a second by Bob Burr for Staff <br />recommendation that the Board revise the schedule adopted at the May 2003 <br />Board meeting. Staff is requesting to move the hearing date from September <br />24,2003 to November 19, 2003, to allow more time to work with the parties. <br />In addition, staff is requesting the Board delay the Prehearing Statement, <br />Prehearing Conference and the deadline for Rebuttal Statements, which the <br />Hearing Officer will oversee. <br /> <br />The motion was approved 9-0. Carolyn McIntosh was not present. <br /> <br />25. Stream and Lake Protection Section - Request that the Staffbe Authorized to Initiate a <br />Rulemaking Change to Rule 6g of the ISP Rules <br />Tape 3, Track 1 3:49:20-3:52:20 <br />Action: A motion was made by Don Schwindt with a second by Harold Miskel for <br />staff recommendation that the Board authorized Staff to initiate a limited <br />rulemaking process to amend Rule 6g to comport with the new statutory <br />language established by House Bill 1320. Staff will bring a proposed <br />amended Rule 6g to the Board for its review at the September Board meeting. <br /> <br />The motion was approved 8-0.
