The
application requests year round flow rates from 185 cfs up to 1400 cfs. A copy of the application is
attached to the memo associated with Board Agenda Item No. 25.

.

The RICD statute provides that the Board may appear in water court to defend its findings with regard to
an RlCD application. There a number of additional reasons why the Board may oppose the application;
therefore the Staff filed a statement of opposition in April.

There were 53 statements of opposition filed, including governmental entities, private citizens, and
businesses. Some of the entities who filed statements of opposition include the following: La Plata
County, the Southwestern Water Conservation District, the Bureau of Reclamation, the State Engineer
and the Division Engineer for Water Division No.7 and the Durango West Metropolitan District.

Staff Recommendation
The Staff recommends that the Board ratify the Staffs statement of opposition for the City of Durango
RlCD case.

.

Colorado Water Conservation Board
Flood Protection.
