Emmons Iron Fen <br />(Water Division 4) <br /> <br />Dear Rod: <br /> <br />In accordance with Rule S.52(A) of the CWCB's Ru1es Concerning the Colorado <br />Instream Flow and Natural Lake Levels Program (the "CWCB Rules"), this letter constitutes Mt. <br />Emll10ns Mining Company's Notice to Contest the CWCB staffs recommendation for a natural <br />lake level at the Mt. Emmons Iron Fen (Water Division 4). <br /> <br />To the extent known at the present time, when it makes its contest Mt. Emmons Mining <br />Company may rely upon the Appendices to the CWCB Staff recommendation; previous studies <br />of the Iron Fen, including but not lirnited to studies analyzing the quality of the water in the Iron <br />Fen and the hydrologic relationship between the springs that feed the fen and groundwater in the <br />Mt. Emmons Mine; and Mt. Emmons Mining Company's application for water rights in <br />96CW311. Mt. Emmons Mining Company also reserves the right to rely upon other data in <br />contesting this recommended lake level. <br /> <br />Without providing an all-inclusive list of the contested facts, Mt. Emmons Mining <br />Company questions whether the CWCB' s right wou1d be capable of administration. In addition, <br />the CWCB lacks authority under Colorado law to be legally entitled to the continuation a certain <br />type of water quality for a lake level that it appropriates. <br /> <br />{77453:1} <br />
