We believe that the over zealous quantification of the water in the <br />Stream will cause a severe impact upon Wolf if and when Wolf applies for a <br />change in use application. In such a situation, Wolf will improperly be forced to <br />leave more water in the stream than there ever has been since Wolf's <br />predecessors commenced their diversions. <br /> <br />5. The CWCS should take into account the fact that what ever minimal <br />stream flow is there it is probably due to the Hughes Ditch trans basin diversion <br />from Fall Creek and the return flow from irrigation from the same. If that trans <br />basin diversion or the return flows there from are ever curtailed, the CWCS needs <br />to adjust its Instream Flows so that Wolf is not injured in the event it attempts a <br />change after such event. <br /> <br />6. To the extent not addressed in this letter, Wolf adopts any and all <br />statements made by Minion Hydrologic on behalf of Corzine and Irwin. <br /> <br />Thank you for consideration of this Notice to Contest.
