<br />III <br /> <br />ARTICLE XI <br /> <br />I <br /> <br />Subjectta the provisians .of this Campact, the <br />cansumptive use .of the water .of the Little Snake River <br />and its tributaries is hereby appartianed between Cala- <br />rada and Wyaming in such quantities as shall result from <br />the applicatian .of the fallowing principles and procedures: <br /> <br />(a) Water used under rights existing priar ta <br />the signing .of this Compact. <br /> <br />(1) Water diverted from any tributary .of <br />the Little Snake River or from the main stem <br />.of the Little Snake River abave a point .one <br />hundred feet below the canfluence of Savery <br />Creek and the Little Snake River shall be <br />administered without'regard ta rights cover- <br />ing the diversian of water' from any down <br />stream points. <br /> <br />(2) Water diverted from the main stem .of the <br />Little Snake Rilfer below a paint .one hundred <br />feet below the oanfluence .of Savery Creek and <br />the Little Snake River shall be administered an <br />the basis .of an interstate priarity schedule <br />prepared by the Cammissian in confonnity with <br />priari ty dates established by the laws .of the <br />respective States. <br /> <br />(b) Water used under rights initiated subsequent <br />ta the signing .of this Campact. <br /> <br />(1) Direct now diversians anall be sa admini- <br />stered that in t.iJJe .of shortage, the curtail- <br />ment .of use an.each acre of land-irrigated' <br />thereunder shall be as nearly equal as may be <br />poSSible in bath .of the States. <br /> <br />I <br /> <br />(2) The star age .of water by projects lacated <br />in either state, whether .of supplemental supply <br />.or .of water used ta irrigate land nat irrigated <br />at the date .of the signing .of this Compact, <br />shall be so administered'that in times .of <br />water shartage the curtailment .of starag@ .of <br />water available for each acre .of land irrigated <br />thereunder shall be as nearly equal as may be <br />possible in bath states. <br /> <br />(c) Water uses under the apportianment made by this <br />Article shall be in accardance with the princi- <br />ple that beneficial use shall be the basis, <br />measure and limit .of the right to use. <br /> <br />(d) Calarada and Wyoming each assent ta diversians <br />and starage .of water in .one State for useein. <br />the ather state. <br />
