<br />Director of the board and notice of the request is given to the community, if different from the <br />entity requesting the variance, that would be affected by the variance, if granted. <br /> <br />B. Contents of a Request for Variance. The request for a variance shall identify~ <br />1. The rule from which the variance is requested, <br />2. The communities that would be affected by the variance, <br />3. The reasons why the rule cannot or shall not be complied with, <br />4. The estimated difference in water surface elevations, flood velocities and flood <br />boundaries that will result if the requested variance is granted than if the <br />calculations are made through strict compliance with the rule, <br />5. The estimated number of people and structures that will be impacted by granting of <br />the variance, and <br />6. Any other evidence submitted by the community, the Colorado Water Conservation <br />Board staff, or other party of interest. <br /> <br />. <br /> <br />C. Factors to be considered. Variances may be issued by the Board if it can be determined that: <br />1. There is a good and sufficient cause, and <br />2. The variance is the minimum necessary, considering the flood hazard, to afford <br />relief, and <br />3. Failure to grant the variance would result in exceptional hardship to the community <br />and that the hardship is' not the community's own making. <br />4. The granting of a variance will not result in increased vulnerability to flood losses, <br />additional threats to public safety, extraordinary public expense, create nuisances, <br />cause fraud or victimization of the public, hide information of significant interest to <br />the public or conflict with existing local laws or regulations. <br /> <br />. <br /> <br />Rule 15. Incorporation bv Reference: The Statement of Basis and Purpose for the <br />Adoption of these Floodplain Designation and Approval Rules is incorporated by <br />reference as part of these rules. <br /> <br />Rule 16. Severability: If any portion ofthese Floodplain Designation and Approval Rules is found <br />to be invalid, the remaining portion of the rules shall remain in force and in effect. <br /> <br />Rule 17. Adopt local standards above and beyond the FEMA and CWCB minimum requirements. <br />B. Develop a Flood Response Plan that identifies responsibilities/actions before, during and after a <br />flood event. <br />C. Enroll in FEMA's National Flood Insurance Program (NFIP) and possibly FEMA's <br />Community Rating System (CRS) Program. <br />D. Develop an early warning flood detection system (flood warning system) using available <br />technologies such as automated precipitation and stream flow gages linked to an appropriate <br />notification system. <br />E.
