<br />e <br /> <br />. <br /> <br />. <br /> <br />Consent Agenda Item I.d <br />Case No. 6-05CW023; Application of Deerwood Service Company, LLC <br /> <br />Application Summary <br /> <br />This is an application for a change of water right and approval of a plan for augmentation and <br />exchange near Steamboat Springs. Applicant plans to provide replacement water for any out-of- <br />priority depletions that may result from the use of water by individuals and entities served by the <br />Applicant through DP Well Nos. 3 and 4, Applicant seeks to change the water right decreed to <br />Deerwood Pond to include augmentation, replacement, and exchange in order to allow Deerwood <br />Pond (including 2nd and 3m fillings) to be used for augmentation ofDP Wells 3 and 4. Replacement <br />water from Deerwood Pond will be released to Whetstone Creek, which joins Trout Creek. Since <br />the pumping of water from the wells also depletes the flow of Trout Creek upstream of its confluence <br />with Whetstone, Applicant proposes to exchange water to augment out-of-priority depletions that <br />occurs upstream of the confluence of Trout Creek and Whetstone Creek. The maximum rate of the <br />proposed exchange is 0.08 cfs with a June 28, 2005 appropriation date. <br /> <br />CWCB Appropriations <br /> <br />The Board holds the following instream flow water rights that may be injured by this application: <br /> <br />CWCB Case Stream/Lake Amount Approp. The Applicant's proposed plan for <br />augmentation including exchange may injure the Board's instream flow water rights on Trout Creek <br />by not replacing depletions in time, place and amount. <br /> <br />Other Objectors <br /> <br />Staff was unable to obtain information on other statements of opposition to this application and <br />will have that information at the Board meeting. <br />
