California Ouantification Settlement Agreement and Related Agreements and <br />Documents -- The Colorado River Water Delivery Agreement: Federal <br />Ouantification Settlement Agreement for pumoses of Section 5(B) of the <br />Colorado River Interim Sum Ius Guidelines was signed bv the Secretary of <br />Interior and others on October 10. 2003 <br /> <br />Section 37-92-102 C.R.S. requires applicants for Recreational In-channel Diversion water <br />rights to provide a copy of their application to the Board. The Board must review the <br />application and submit findings and recommendations to the water court within 90 days <br />of filing a Statement of Opposition. The Board must determine whether the water right <br />would promote the maximum beneficial use of water; impair the development of compact <br />entitlements; the stream reach is appropriate and accessible; injure a CWCB instream <br />flow; and evaluate other appropriate factors set forth in the Board's rules. <br /> <br />Flood Protection <br /> <br />The Flood Protection Program is directed in ~ 37-60-106(1) C.R.S. (1990) to prevent <br />flood damages, review and approve floodplain designations prior to adoption by local <br />government entities, and provide local jurisdictions with technical assistance and <br />floodplain information. <br /> <br />State statutes encourage operations, research, experimentation, and development in the <br />field of weather modification. These statutes require that operations be carried out with <br />proper safeguards and by non-state governmental entities. The authority for carrying out <br />this statute was given to the DNR Executive Director who has delegated this <br />responsibility, up to the point of issuing a permit, to the CWCB (36-20-101 to 36-20-127 <br />C.R.S.) <br /> <br />In 2002, the General Assembly created a Watershed Protection Fund to be financed with <br />money from an annual tax check-off. The Fund was created because protecting the <br />natural heritage and quality of life in Colorado are of fundamental importance and locally <br />based collaborative approaches to the restoration and protection of lands and natural <br />resources within Colorado's watersheds can be and should be conducted in concert with <br />economic development. The CWCB manages these funds in cooperation with the <br />Colorado Water Quality Control Commission and in consultation with the Colorado <br />Watershed Assembly in the annual distribution of grants (39-22-240lto 39-22-2403 <br />C.R.S.). <br /> <br />The CWCB must also implement Executive Orders related to Flood Protection: <br /> <br />. An August 1, 1977 Executive Order requires the CWCB and Land Use <br />Commission to provide assistance to entities in meeting the requirements of the <br />National Flood Insurance Program. <br />. An October 1, 1977 Executive Order designating the CWCB as the state agency <br />responsible administering duties and responsibilities associated with the National <br />Flood Insurance Program in Colorado. <br /> <br />Page 3 of 5 <br />
