In addition, such water will, at times, be <br />exchanged into Sprucedale Reservoir and Sprucedale Ditch. Direct <br />flow water available to Buffalo P~rkifrom MMRC will be left in the <br />stream or water will be released iro~ storage at a rate equivalent <br />to the rate at which depletions from! water usage in the Cragmont, <br />Mountain Park Homes, Buffalo MeadoWs and Homestead Subdivisions <br />are then occurring andlor water is oeing diverted into Sprucedale <br />Reservoir. In this way, . the flow cif water in the stream system <br />below the point where replacement. water is delivered will be <br />unaffected by water usage within the respective subdivisions or <br />diversions into Sprucedale Reservoir;. If the calling water right <br />is within the Harriman Ditch system; MMRC may release water from <br />Soda Lakes Reservoirs directly to t~e Harriman Ditch, or MMRC may <br />deliver its direct flow rights to th~ Harriman Ditch at either the <br />Bear Creek or Turkey Creek headg~te~; provided, however, that any <br />use of the April 16, 1862 priortty. decreed to the Warrior Ditch <br />and the April 15, 1868 priority decreed to the Harriman Ditch <br />shall be subj ect to the conditions set forth in Paragraph Nos. <br />6.5, 6.7 and 6.8, herein. <br /> <br />6.3.1 The reaches of the stream system affected by the <br />Buffalo Park exchanges shall ine;lude sections of Bear Creek and <br />its tributaries, and sections of Tu~key Creek and its tributaries. <br />The downstream point for each e~ch~nge shall be the confluence of <br />Bear Creek and Turkey Creek at Bear Creek Lake in Section 5, <br />Township 5 South, Range 69 We~t,. 6th P.M., Jefferson County, <br />Colorado. . <br /> <br />a. On Bear Creek and its' tributaries, the Buffalo Park <br />exchanges shall extend iupstream to points on Bear <br />Creek, Cub Creek, Blue Creek apd unnamed tributaries of Bear <br />Creek. One arm of the exdhange shall extend from the <br />.. confluence of Bear Creek C(nd' Turkey Creek; thence up Bear <br />Creek to the confluence of Beat Creek and Cub Creek in SW 1/4 <br />NE 1/4 of Section 10, Townshi~ 5 South, Range 71 West, 6th <br />P.M.; thence up Cub Creek to the point of diversion for the <br />Sprucedale Ditch. A second arm of the exchange shall <br />continue up Cub Creek to the c?nfluence of Cub Creek and Blue <br />Creek in the NE 1/4 NW 1/4 of! Section 28, Township 5 South, <br />Range 71 West, 6th P.M.; anc! thence up Blue Creek to the <br />approximate center of Section !28, Township 5 South, Range 71 <br />West, 6th P.M. A third arm of! the exchange shall extend from <br />the confluence of Bear Creek a~d Turkey Creek; thence up Bear <br />Creek to the confluence of Bear Creek and an unnamed <br />tributary of Bear Creek in the NW 1/4 of Section 11, Township <br />5 South, Range 71 West, 6th, P.M.; thence up said unnamed <br />tributary to the west line of the NW 1/4 SE 1/4 of Sections <br />11, Township 5 South, Range 7] West, 6th P.M. <br />I <br />b.
