<br />Opposers take no position on "well to well" interference issues of .
<br />concern to the Bear Mountain HOA. A copy of the proposed decree
<br />in 94CW290 (B) is attached hereto as Attachment "2." With the
<br />exception of the Bear Mountain HO~, Opposers consent to and will
<br />not oppose entry of a decree in 94CW290(B) , as long as such decree
<br />is no less restrictive on Applic1il.nts and no less protective of
<br />Opposers than the document attached as Attachment "2."
<br />Applicants' undersigned counsel will provide Opposers' undersigned
<br />counsel, as well as the pro g Opposers, with a copy of any
<br />proposed decree submitted to the Water Judge in this matter which
<br />is different from Attachment "2," to allow Opposers to confirm
<br />that such decree is no less restrictive on Applicants and no less
<br />protective of Opposers than the ~ocument attached as Attachment
<br />112. II

<br />17. Morrison is an Opposer inCase Nos. 99CW096, 99CWl08,
<br />99CWl22 and 99CW171, currently pen~inQ before the Court. Morrison
<br />is an Applicant in Case Nos. 99CW189; and 99CW225, also currently
<br />pending before the Court. Morrison' shall join in a Motion to
<br />rescind the May 7, 2001, Order granting a Stay of proceedings in
<br />Case Nos. 99C:W096, 99CW108, 99CW122 and 99CWl71, and enter into a
<br />stipulation tor the immediate entry of decrees in all four cases
<br />in the forms previously provided. Applicants, in turn, shall
<br />either withdraw their Statements of Opposition filed in Case Nos.
<br />99CW189 and 99CW225, or stipulate to the immediate entry of
<br />decrees in the two cases in the for.ms'previously provid~d.

<br />18. Jefferson County is an Opposer in Case Nos. 98CW451, e
<br />99CW035, 99CW096, 99CW108, 99CW122, 99CW171 and 00CW060.
<br />Jefferson County shall join in a. Motion to rescind \:he May 7,
<br />2001, Order granting a Stay of proceedings in Case Nos. 98CW451,
<br />99CW096, 99CW108, 99CW122, 99CW171, and stipulate to the immediate
<br />entry of decrees in all seven cases in the forms previously
<br />provided.

<br />stipulate to the irmnediate entry of, a decree in the case in the
<br />form previously provided.
