<br />. <br /> <br />Table RocklCWCB Stipulation <br />Case No. 03CW33 I <br />Page 3 of8 <br /> <br />the "TRR Recreation Ponds Reach." This reach is downstream ofthe Oxbow reach. <br />Within the TRR Recreation Ponds Reach, the Ranch has installed 38 additional <br />Structures and completely reshaped the thalweg, all of which were specifically designed <br />to create fish habitat. <br /> <br />c. Applicant has not yet constructed the TRR Meadow Pond, for which a conditional <br />water right is claimed in Case No. 03CW331. The TRR Meadow Pond will be filled by <br />diversions from the TRR Recreation Ditch, Frank Groh Ditch, and/or Frank Groh Ditch <br />2nd Enlargement, and in part by seeps and springs which are intercepted by the Frank <br />Groh Ditch. The plarmed surface area ofthe TRR Meadow Pond is 87000 square feet. <br />Applicant will operate the Meadow Pond pursuant to the terms and conditions of this <br />Stipulation and the Decree in Case No. 03CW331 when entered. <br /> <br />6. In consideration of the substantial habitat improvement that Table Rock has made to <br />Rock Creek throughout the Ranch, and pursuant to Rule 8.i.(3) of the Rules Concerning the <br />Colorado Instream Flow and Natural Lake Level Program, Table Rock and the CWCB agree as <br />follows with respect to diversions for the Fish Habitat Project: <br /> <br />. <br /> <br />a. The parties agree to share the flows in Rock Creek in accordance with paragraphs <br />6.b., c., d., and e. below. The flow rate limitations specified in paragraphs 6.b., c., d., and <br />e. on diversions into the Fish Habitat Project facilities are separate from, and shall not <br />limit, Table Rock's right to divert the following (the "Developed and Imported Water <br />Rights") at those facilities: <br /> <br />1. Table Rock's existing Frank Groh Ditch or Horn No.2 Ditch <br />water rights during the irrigation season; <br /> <br />11. Table Rack's existing Horn Consolidated Ditch and Horn No. I_Ditch <br />water rights, pursuant to the changes of water rights for these Ditches <br />described in the Proposed Decree; <br /> <br />111. Table Rock's rights to delivery and use of Yam cola Reservoir Return <br />Flows pursuant to the Proposed Decree; <br /> <br />IV. Table Rock's rights to delivery and use of any other water transported <br />from the Yampa River basin, or available under other changed upstream <br />water rights or storage releases, pursuant to a valid agreement far the <br />delivery and use af such water. <br /> <br />. <br /> <br />To the extent that water attributable to the Developed and Imparted Water Rights is <br />measured at the stream gages described in the paragraphs 6.b., c., d., and e. below and <br />Table Rack elects to. divert that water into the Fish Habitat Project facilities in addition <br />to, and separately from, the flow rate limitations specified in those paragraphs, the rate of <br />flow afDevelaped and Imparted Water Rights sa diverted shall be subtracted from the <br />gaged flow in computing the total flow at the gage ("Qtotal") far the purposes of <br />calculating the flow rate limitations specified belaw. <br />
