<br />e <br /> <br />. <br /> <br />e <br /> <br />5-86CW217 <br /> <br />Blue River <br /> <br />32.0/1 6.0 <br /> <br />3/14/86 <br /> <br />Applicant has agreed to the following terms and conditions that will provide full <br />protection for the Board's instream flow water rights on the Blue River. <br /> <br />Applicant has an interest in Dillon Storage Water as described in the Memorandum of <br />Agreement dated October 25, 1998 ("MOA"), between Vidler Tunnel Water Co. and the <br />Colorado Water Conservation Board. This MOA enables the Applicant to the release ofthe <br />Dillon Storage Water for exchange in the Blue River basin and to augment diversions in the <br />Upper Blue River. The applicant has agreed to comply with all terms and conditions of <br />Appendix C of the MOA, which places various limitations on the use of the Dillon water in order <br />to provide protection to the Board's instream flow rights. <br /> <br />Applicant will install and maintain such water measuring devices on the subject wells and <br />implement such accounting procedures as may be required to verify that the amount of <br />augmentation and exchange water equals or exceeds the amount of out of priority depletions, and <br />to otherwise administer the Applicant's decree. <br />
