.

.

c~ .

.r

preliminary injunction to assure water in the middle Rio Grande this summer. To avoid a court
order, the Bureau and Corps agreed to give three weeks notice if there will be any dry reaches in
the river. We have been in constant communication with New Mexico and the Justice
Department on this case and will continue to closely monitor it.

ISSUES FOR COLORADO
Colorado has the following interests:

I. Protecting Colorado's rights under the Rio Grande Compact;

2. Protecting Colorado's interests in the Closed Basin Project and Platoro Reservoir;

3. Protecting Colorado's ability to use the San Juan River under the Colorado River Compact;

4. Protecting Colorado water users' interests in contracted water from the Bureau of
Reclamation.

We think that the silvery minnow issues can and should be solved in New Mexico. We are
closely monitoring these cases to determine if and when Colorado should become more actively
involved. Colorado already participates in the Recovery Plan Workgroup and will continue to do
so.

File: p:\nr\nrhatcsc\cwcb report 2.doc

5
