Applicants' out-of-priority depletions may only exceed the monthly <br />historic limits set forth in subparagraph C below if said exceedances are augmented from sources <br />at or above the point(s) of diversion. <br /> <br />C. Whenever the Upper Eagle River ISF is not being satisfied immediately <br />downstream of one of Applicants' active diversion points Applicants shall make all diversions of <br />potable water at the Raw Water Booster Pump, subject to the exception in subparagraph (E) <br />below. Applicants shall be entitled to make non-potable diversions and diversions into storage <br />when the Upper Eagle River ISF is not being satisfied, so long as the above terms and conditions <br />are satisfied. <br /> <br />. <br /> <br />E. Applicants shall always be entitled to divert potable water at the Individual <br />Wells, even when the Upper Eagle River ISF is not being satisfied, so long as the Individual <br />Wells use septic systems and resulting out-of-priority depletions are replaced with historic <br />depletion credits or releases of upstream storage water. In the event that the Individual Wells are <br />not connected to septic systems, Applicants shall always be entitled to divert at the Individual <br />Wells only if out-of-priority diversions are fully augmented with historic depletion credits or <br />upstream storage water. <br /> <br />F. When the Upper Eagle River ISF is not being satisfied during the non- <br />irrigation season, Applicants shall ensure that effluent generated at the Avon Wastewater <br />Treatment Plant, and attributable to the Project, shall be delivered upstream to a point <br />approximately 70 feet downstream of the Raw Water Booster Pump. <br /> <br />G. The Authority agrees to make some stream improvements in the reach <br />between the Raw Water Booster Pump and the point where effluent may be delivered upstream <br />pursuant to subparagraph (F), consisting of the movement and/or placement of rocks, to help <br />direct Eagle River flows toward the North bank of the Eagle River during times of low flows to <br />help maintain a fish passage in this 70 foot reach. <br /> <br />. <br /> <br />H. The provisions set forth above in sub-paragraphs (F) and (G) shall only be <br />required when the following "triggers" are both satisified: (i) when the Project reaches 30% <br />build-out (as measured by single family equivalents); and (ii) when the average daily treated <br />water demand at the Avon Water Treatment Plant increases 0.35 c.f.s. above the base water <br />demand during the period of October I through April 30. Said "base water demand" shall be the <br />average daily treated water demand at the Avon Water Treatment Plant during the October I <br />through April 30 period that precedes any build-out of the Project.
