WHEREAS, the Board of County Commissioners of Douglas County
has requested the Colorado Water Conservation Board to designate
and approve the floodplain and floodprone areas as set forth in
the aforesaid report; and

WHEREAS, the United States Army Corps of Engineers, Omaha
District, has completed a floodplain information report entitled
"Floodplain Information, Cherry Creek, Cherry Creek Lake Through
Franktown, C'olorado," dated October, 1976; and

WHEREAS, a floodplain information report entitled "Flood
Hazard Area Delineation, Happy Canyon Creek, Badger Gulch, Newlin
Gulch, Baldwin Gulch, Sulphur Gulch, and Tallman Gulch," dated
November, 1977, was completed by Howard Needles Tammen & Bergen-
doff at the request of the Urban Drainage and Flood Control
District, Douglas County, and Arapahoe County; and

WHEREAS, the Colorado Water Conservation Board by Resolution
No. 68 adopted on July 27, 1977, and Resolution No. 96 adopted
on January 19, 1978, respectively, approved and designated the
floodplains described in the aforesaid reports; and

WHEREAS, Section 37-60-106(1), Colorado Revised Statutes
1973, requires the Colorado Water Conservation Board to assist
in the prevention of floods and flood damages therefrom; and

IVHEREAS, Sections 31-23-201 and 30-28-111, Colorado Revised
Statutes 1973, provide that such legislative bodies of local
jurisdictions may provide zoning regulations for land uses on
or along any storm or floodwater runoff channel or basin only
after designation and approval by the Colorado Water Conserva-
tion Board; and

WHEREAS, Douglas County officials have stated that they
will regulate the storm and floodwater runoff channels (Zone A)
on a case-by-case basis subject to a detailed hydrologic and
hydraulic analysis by a professional'engineer; and

WHEREAS, Section 37-60-106(1) (c), Colorado Revised Statutes
1973, directs the Colorado Water Conservation Board to ~esignate
and approve storm or floodwater runoff channels or basins and
to make such designations available to legislative bodies of
local jurisdictions; and

WHEREAS, the staff of the Board has reviewed the flood in-
surance study and does hereby recommend to the Colorado Water
Conservation Board that the Board designate ~nd approve as flood-
plain areas those areas inundated by a lOO-y,ear flood (intermediate
regional flood) as described by the floodwat,er surface elevations
and profiles in said report and designate and approve as storm
or floodwater runoff channels or basins thos,= areas as delineated
by Zone A in said report.
