<br />------ -""- <br /> <br />WHEREAS, the Board of County Commissioners of Douglas County <br />has requested the Colorado Water Conservation Board to designate <br />and approve the floodplain and floodprone areas as set forth in <br />the aforesaid report; and <br /> <br />WHEREAS, the United States Army Corps of Engineers, Omaha <br />District, has completed a floodplain information report entitled <br />"Floodplain Information, Cherry Creek, Cherry Creek Lake Through <br />Franktown, C'olorado," dated October, 1976; and <br /> <br />WHEREAS, a floodplain information report entitled "Flood <br />Hazard Area Delineation, Happy Canyon Creek, Badger Gulch, Newlin <br />Gulch, Baldwin Gulch, Sulphur Gulch, and Tallman Gulch," dated <br />November, 1977, was completed by Howard Needles Tammen & Bergen- <br />doff at the request of the Urban Drainage and Flood Control <br />District, Douglas County, and Arapahoe County; and <br /> <br />WHEREAS, the Colorado Water Conservation Board by Resolution <br />No. 68 adopted on July 27, 1977, and Resolution No. 96 adopted <br />on January 19, 1978, respectively, approved and designated the <br />floodplains described in the aforesaid reports; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised Statutes <br />1973, requires the Colorado Water Conservation Board to assist <br />in the prevention of floods and flood damages therefrom; and <br /> <br />IVHEREAS, Sections 31-23-201 and 30-28-111, Colorado Revised <br />Statutes 1973, provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on <br />or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water Conserva- <br />tion Board; and <br /> <br />WHEREAS, Douglas County officials have stated that they <br />will regulate the storm and floodwater runoff channels (Zone A) <br />on a case-by-case basis subject to a detailed hydrologic and <br />hydraulic analysis by a professional'engineer; and <br /> <br />WHEREAS, Section 37-60-106(1) (c), Colorado Revised Statutes <br />1973, directs the Colorado Water Conservation Board to ~esignate <br />and approve storm or floodwater runoff channels or basins and <br />to make such designations available to legislative bodies of <br />local jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed the flood in- <br />surance study and does hereby recommend to the Colorado Water <br />Conservation Board that the Board designate ~nd approve as flood- <br />plain areas those areas inundated by a lOO-y,ear flood (intermediate <br />regional flood) as described by the floodwat,er surface elevations <br />and profiles in said report and designate and approve as storm <br />or floodwater runoff channels or basins thos,= areas as delineated <br />by Zone A in said report. <br /> <br />-2 - <br />
