<br />90 days for review and comment before the Board is asked to take <br />any formal action. <br /> <br />If comments are received by the staff after distribution of <br />the Preliminary Notice, which comments could be sent directly to <br />the staff or presented publically at the Board meeting, every <br />reasonable effort will be made to address those comments before <br />the stream or lake in question is included in a Final Notice. If <br />a party still disagrees with the staff's recommendation as em- <br />bodied in a Final Notice, he will have a second opportunity to <br />appear before the Board when the Board considers the Final Notice. <br /> <br />A cover memorandum will accompany each notification explain- <br />ing what each notice is and how one may approach the staff and/or <br />the Board to make his concerns known. Sample memorandums are <br />attached for your review. <br /> <br />Adequate Review by CWCB Staff <br /> <br />Concern has been expressed from time to time that the CWCB <br />staff does not give the Division of Wildlife's minimum streamflow <br />recommendations a thorough enough review before passing these <br />recommendations on to the Board. While this is not generally <br />true, improvements can be made. Thus, we are requiring henceforth <br />that DOW minimum streamflow recommendations be received 75 days <br />before any Board meeting. This will allow 45 days for CWCB staff <br />review of the recommendations prior to the mailing of the Pre- <br />liminary Notice. <br /> <br />Summary <br /> <br />The following is a summary of the foregoing recommendations <br />to modify the procedures used by the staff and Board in acting <br />on minimum streamflow appropriations. A diagram illustrating <br />this procedure and the timing involved is attached. <br /> <br />1. Deadline for receipt of Division of Wildlife minimum stream- <br />flow recommendations: 75 days prior to any Board meeting. <br /> <br />2. CWCB staff review of DOW recommendations: 45 days. <br /> <br />3. Preliminary Notice: mailed 30 days prior to Board meeting. <br />Public comment period begins at this time. <br /> <br />4. Board Meeting: receipt of Preliminary Notice is acknowledged <br />and submitted for the record. Public comments, if any, are <br />recorded. <br /> <br />5. Final Notice: mailed 30, days prior to Board meeting. <br /> <br />6. Board Meeting (approximately 60 days since last meeting) : <br />formal Board action upon staff recommendations which appear <br />in the Final Notice (Board can approve, modify, or refer a <br /> <br />3 <br />
