<br />e <br /> <br />e <br /> <br />e <br /> <br />MEMORANDUM <br /> <br />TO: Colorado Water Conservation Board Members <br /> <br />FROM: Dan Merriman <br />Mark Uppendahl <br /> <br />DATE: September 21-22, 1998 <br /> <br />SUBJECT: Agenda Item 9c, September 21-22, 1998, Board Meeting- <br />Instream Flow Program - New Appropriations <br />Notice to Appropriate Instream Flow Water Rights in Water Division 4 <br /> <br />GENERAL BACKGROUND <br /> <br />A Final Notice regarding the Board's Intent to Appropriate Instream Flow Water Rights was <br />distributed to the public on July 28, 1998. CWCB staff met with Ken Knox of the Division 4 <br />Engineer's Office on August 26, 1996, to discuss any water availability problems regarding the <br />proposed instream flow segments. As per the Procedures for New Instream Flow Appropriations <br />(procedures), adopted by the Board in May of 1997, the attached Phase ill streams are being <br />proposed for Board appropriation. The Board at its January 1998 and May 1998, meetings, fonned <br />its intent to appropriate the attached stream segments in Gunnison, Hinsdale and Saguache Counties <br />(see attached maps). At these meetings the proposed ISF segments were advanced to the Public <br />Review and Comment and Board Action Phase, or Phase ill. <br /> <br />The public has had at least 120 days, to provide written and/or verbal comments to the Board and <br />staff. Please find attached any written comments received by the Board or staff during this time. The <br />Bureau of Land Management (BLM) and/or the Colorado Division ofWild1ife (CDOW) identified <br />these stream reaches for inclusion into the instream flow program. <br /> <br />TECHNICAL INVESTIGATIONS <br /> <br />The enclosed packet of technical data forms the basis for the staffs recommendations and reflects any <br />changes to the instream flow recommendations as a result of the 120 day Public review and Comment <br />Period. <br /> <br />Page 1 00 <br />
