We advocate that this 1.5 miles segment of the Muddy Creek (only .5 mile is <br />public land) from the confluence of the West Muddy and the East Muddy does not meet <br />the criteria of the ISF roles. ISF are to be appropriated when a natural environment can be <br />preserved to a reasonable degree with an instream flow water right. (See 37-92-102 (3) <br />CRS.) <br /> <br />. <br /> <br />Next, the water availability analysis in the North Fork of the Gunnison Basin has <br />a major flaw. It assumed the availability of augmentation water from the Paonia <br />Reservoir. Although decreed for all uses, the Bureau of Reclamation currently allows <br />only irrigation with this water. Anyone with water is this reservoir is unlikely to sell it as <br />the money would then go to the Bureau. <br /> <br />Additionally, we feel that it is unjust for CWCB to impose this appropriation. <br />Generally, the public of the North Fork Valley is opposed to these filings. Individuals <br />who attended one or all of the three meetings held in the valley last year spoke against <br />this proposal. To go ahead with these filing would indicate to us, a government agency <br />that is indifferent to its constituents. <br /> <br />Although we concentrated our examination of your info on the Muddy Creek that <br />is tributary to the North Fork of the Gunnison, we question the data presented relevant to <br />other segments of the North Fork ofthe Gunnison. Experts and lay persons-SWIS and <br />IBC's-- are questioning the amount of water that is available in the Gunnison Basin. Until <br />there is a definitive answer to this question, we feel all ISF's should be curtailed. <br /> <br />. <br /> <br />If the CWCB goes ahead with the proposed filings on Muddy Creek above the <br />Paonia Reservoir, we will pursue any, and all, avenues to oppose that action. <br /> <br />Sincerely, <br /> <br />Dixie L.
