The motion was seconded by David <br />Harrison. Jim Lochhead modified the motion to include authorization <br />to proceed to trial if stipulation comes to trial before the next Board <br />meeting. A substitute motion was made by David Harrison stating <br />that the Board authorize approval of the stipulation, essentially the <br />same one signed by applicant's attorney, provided that it include an <br />additional provision specifying there be a covenant running with the <br />lots benefitted by this particular water right or aUgnientation plan, <br />executed in accordance with normal requirements for a restricted <br />covenant and that the requirement be added to the language of the <br />stipulation. In addition, the Board (staff) formally communicate with <br />Summit County a conCern about the problem of the cumulative impact <br />of these several kinds of small water rights that are not really being <br />accounted for, provided for on a year round basis. The motion was <br />seconded by Jim Lochhead. The substitute motion was changed to <br />state that the Board approve a stipulation along the lines of the one <br />included here provided that it contains a provision that it be reportable <br />in some appropriate legal form that is associated with the land in this <br />case and also that the motion further says that the Board will contact <br />the County with concerns about this.
