Case No. 1-87CW265;East Fork Sheep Creek <br /> <br />Case Summary <br /> <br />The Board approved the final recommendation for the East Fork Sheep Creek <br />instream flow appropriation at its December 1987 meeting. The filing under this <br />appropriation extends from the headwaters to the confluence with the confluence with West <br />Fork Sheep Creek (see attached map). The amount of water claimed by the Board is 3 cfs <br />for the period April 1 through September 30, and 1 cfs for the period October 1 through <br />March 31. <br /> <br />The City of Fort Collins filed a statement of opposition to the Board's application <br />stating that Fort Collins is the owner of existing decreed water rights and conditional water <br />rights within the proposed instream flow segment and that the City's rights may be adversely <br />affected by the Board's appropriation. Subsequent discussions with Fort Collins indicated <br />that the the City's primary concern was that the Board's appropriation on East Fork Sheep <br />Creek may interfere with its senior decreed water rights in Sheep Creek Reservoir and <br />conditional exchanges to the reservoir. <br /> <br />Discussion <br /> <br />. <br /> <br />The Division 1 Referee has expressed concern over the fact that this case is still <br />unresolved. He has set the case for a status conference on June 1, 1993, and has asked that <br />both parties work diligently to resolve the case before that time. The Board and Attorney <br />
