Case Summary

The Board approved the final recommendation for the East Fork Sheep Creek
instream flow appropriation at its December 1987 meeting. The filing under this
appropriation extends from the headwaters to the confluence with the confluence with West
Fork Sheep Creek (see attached map). The amount of water claimed by the Board is 3 cfs
for the period April 1 through September 30, and 1 cfs for the period October 1 through
March 31.

The City of Fort Collins filed a statement of opposition to the Board's application
stating that Fort Collins is the owner of existing decreed water rights and conditional water
rights within the proposed instream flow segment and that the City's rights may be adversely
affected by the Board's appropriation. Subsequent discussions with Fort Collins indicated
that the the City's primary concern was that the Board's appropriation on East Fork Sheep
Creek may interfere with its senior decreed water rights in Sheep Creek Reservoir and
conditional exchanges to the reservoir.

Discussion

The Division 1 Referee has expressed concern over the fact that this case is still
unresolved. He has set the case for a status conference on June 1, 1993, and has asked that
both parties work diligently to resolve the case before that time. The Board and Attorney
