Case No. 1-87CW291; Killpecker Creek

Case Summary

The Board approved the final recommendation for the Killpecker Creek instream
flow appropriation at its December 1987 meeting. The filing under this appropriation
extends from the headwaters to the confluence with the North Fork Cache La Poudre River
(see attached map). The amount of water claimed by the Board is 2 cfs for the period May
1 through October 31, and 1 cfs for the period November 1 through April 30.

The Red Feather Storage and Irrigation Company filed a statement of opposition to
the Board's application stating that the proposed use of the water would alter stream
depletions and return flows which would adversely affect and change the historic burden on
the stream.

Discussion

The Division 1 Referee has expressed concern over the fact that this case is still
unresolved. He has set the case for a status conference on June 2, 1993, and has asked that
both parties work diligently to resolve the case before that time. The Board and Attorney
General Staff are in the process of evaluating a proposed stipulation in the case and have
requested additional information from the Red Feather Storage and Irrigation Company.
The staff will continue to diligently pursue resolution of this case and will keep the Board
apprised of any developments.
