The filing under this appropriation <br />extends from the headwaters to the confluence with the North Fork Cache La Poudre River <br />(see attached map). The amount of water claimed by the Board is 2 cfs for the period May <br />1 through October 31, and 1 cfs for the period November 1 through April 30. <br /> <br />The Red Feather Storage and Irrigation Company filed a statement of opposition to <br />the Board's application stating that the proposed use of the water would alter stream <br />depletions and return flows which would adversely affect and change the historic burden on <br />the stream. <br /> <br />Discussion <br /> <br />The Division 1 Referee has expressed concern over the fact that this case is still <br />unresolved. He has set the case for a status conference on June 2, 1993, and has asked that <br />both parties work diligently to resolve the case before that time. The Board and Attorney <br />General Staff are in the process of evaluating a proposed stipulation in the case and have <br />requested additional information from the Red Feather Storage and Irrigation Company. <br />The staff will continue to diligently pursue resolution of this case and will keep the Board <br />apprised of any developments. <br /> <br />e <br /> <br />DCM/JB <br />Attachment <br />187CW29UNF <br /> <br />I; <br />
