The filing under this
appropriation extends from the outlet of Button Rock Reservoir to the confluence with
South Saint Vrain Creek (see attached map). The amount of water claimed by the Board
is 21 cfs for the period April 1 through October 31, 14 cfs for the period November 1
through November 30, and 8 cfs for the period December 1 through March 31.

The City of Longmont and the Highland Ditch Company filed statements of
opposition to the Board's application to "ensure that the Colorado Water Conservation
Board has made the necessary statutory findings pursuant to C.R.S ~ 37-92-102 (3) (c)".

Discussion

The Division 1 Referee has expressed concern over the fact that this case is still
unresolved. He has set the case for a status conference on June 2, 1993 and has asked that
.both parties work diligently to resolve the case before that time. The Board Staff has met
with the objector on several occasions within the past year to discuss various options which
would resolve the case to the satisfaction of both parties. The staff will continue to
diligently pursue resolution of this case and will keep the Board apprised of any
developments.

e

DCM/JB
Attachment
187CW2112.INF

I
