The filing under this
appropriation extends from the confluence with Middle Saint Vrain Creek to the headgate
of the Longmont Diversion (see attached map). The amount of water claimed by the Board
is 20 cfs for the period April 1 through September 30, and 12 cfs for the period October 1
through March 31.

The City of Longmont filed a statement of opposition to the Board's application to
"ensure that the Colorado Water Conservation Board has made the necessary statutory
findings pursuant to C.R.S ~ 37-92-102 (3) (c)".

Discussion

The Division 1 Referee has expressed concern over the fact that this case is still
unresolved. He has set the case for a status conference on June 2, 1993 and has asked that
both parties work diligently to resolve the case before that time. The Board staff has met
with the objector on several occasions within the past year to discuss various options which
would resolve the case to the satisfaction of both parties. The staff will continue to
diligently pursue resolution of this case and will keep the Board apprised of any
developments.

DCM/JB
Attachment

r
