The filing under this appropriation <br />extends from the confluence with North Fork Joe Wright Creek to the confluence with <br />Chambers Lake (see attached map). The amount of water claimed by the Board is 5 cfs for <br />the period April 1 through September 30, and 2 cfs for the period October 1 through March <br />31. <br /> <br />The City of Fort Collins filed a Statement of Opposition to the Board's application <br />indicating that an appropriation of water for instream flows could adversely affect the <br />historic operation of, and existing exchanges to, Joe Wright Reservoir which is located <br />upstream of the Board's instream flow reach. <br /> <br />Proposed Stipulation <br /> <br />The attached stipulation, which has been accepted by the applicant and <br />recommended by the Attorney General's staff, provides that Fort Collins will consent to the <br />entry of a decree in the Board's case, so long as the following terms and conditions are <br />included in the decree: <br /> <br />1. <br /> <br />The instream flow right will not prevent the operation of any exchange or alternate <br />point of diversion involving Joe Wright Reservoir which was decreed prior to <br />December 11, 1987. <br /> <br />e <br />
