The filing for this appropriation extends from <br />the confluence with an unnamed tributary to the confluence with Spring Gulch (see attached <br />map). The amount of water claimed by the Board is 1 cfs year round. <br /> <br />The Left Hand Ditch Company imd the Saint Vrain and Left Hand Water <br />Conservancy District filed statements of opposition to the Board's application based on <br />concerns regarding water availability. Subsequent discussions with the Water Conservancy <br />District identified additional concerns that the Board's appropriation on Left Hand Creek <br />would interfere with its historic exchange of water to the Left Hand Park Reservoir which <br />was subsequently decreed in Case No. 89CW238. The District's attorney has supplied the <br />Board staff with an affidavit which substantiates this historic exchange. <br /> <br />Proposed Stipulation <br /> <br />e <br /> <br />The attached stipulation, which has been accepted by the applicant and <br />recommended by the Attorney General's staff, provides that the Saint Vrain and Left Hand <br />Water Conservancy District will consent to the entry of a decree in.the Board's case, so long <br />as the water rights decreed for instream flow purposes on Lefthand Creek recognize the <br />operation of the Lefthand Park Reservoir exchange decreed in Case No. 89CW238. The <br />Lefthand Ditch Company has chosen not to stipulate to any specific terms and conditions <br />and have indicated their intent to sign off on the Board's proposed decree. <br /> <br />\ <br />
