Evans <br />Acting Director, eweR <br /> <br />TO: <br /> <br />Colorado Water Conservation Board Members <br /> <br />FROM: Larry Lang <br /> <br />DATE: July 10, 1998 <br /> <br />SUBJECT: Agenda Items 4.d., July 13-14, 1998 Board Meeting-- <br />South Platte River Channel Project, Right-of-Way Action <br /> <br />INTRODUCTION <br /> <br />At the March 12, 1996, Board Meeting, approval was given to the "Consent to assignment of <br />the original lease" between COLORADO WATER CONSERVATION BOARD AND <br />RIVERFRONT DEVELOPMENT for certain lands located within the South Platte River <br />Channel Improvement Project right-of-way. On October 10, 1986, the CWCB entered into this <br />lease with the Riverfront Development Corporation. Under the provisions of the lease, the <br />Pitchers Restaurant building was constructed both on the leased land and on privately owned <br />land, The Board has considered a number of requests to "Consent to assignment of the original <br />lease" dated October 10, 1986, <br /> <br />DISCUSSION <br /> <br />The staff, in conjunction with the Attorney General's Office, has reviewed the existing lease and <br />said lease provides the opportunity to assign the original lease to another following an approval <br />by Colorado Water Conservation Board, The Board's staff has received a request from the <br />Starwood Investments Inc, to the "Concent to assignment of the original lease" which is presently <br />assigned to 1100 Drake, Ltd, dated April 1996 - See attached letter, <br /> <br />RECOMMENDATION <br /> <br />The staff, having reviewed the applicant's request and the provisions of the existing lease <br />recommends that the Board approve the "consent to the assignment of the lease" from 1100 <br />Drake, Ltd, to Carrera Four, Inc" direct staff to prepare the required documents to complete <br />this transaction, and authorize the Director to execute any documents, <br /> <br />1 <br />
