Conservation benefits iRc1ude protection' ana restoration of.
, Colorado's water-dependent natural heritage plus maintenance of open .space and wildlife
habitat provided by irrigated agriculture.

.

CWT haS paid for an option agreement with the sellers for 8.5 cfs. The water was
,historically diverted from,Boulder Creek arid used to irrigate pasture in SumrnitCounty.
The water rights owners, members of the Blue River agricultural community for nearly
50 years, sold the land to the United S~tes Forest Service but retained the water rights. .
To the extent possible, the sellers want the water to be used for conservation benefits in
, Summit County.

,

. ,

.

The terms of the signed option agreement between the sellers and CWT created time
constraints.'CWT has risked $10,000 and is obligated to complete the purchase by the
end of September 2004. Consequently, CWI is asking the CWCB to forrhally consider
this donation during the Board meeting in May 2004. '

Over the past year, CWT worked closely with Lmda Bassi, Anne Janicki,'and ban
Merriman arid drBfted the proposed acquisition agreement between CWT and the CWCB.
The draft acquisition agreement ojltlines the terms of the donation. The benefits from this
donation are'an instream flow right that causes no injury, which bolsters an eXisting,
junior instreilm floW right held by CWCB, and that preserves and improves the natural ,
environment. '

David HarriS()Il; a CWT board member, and I will attend the CWCB meeting on May 25
and be prepared tofurfuer describe the proposed donation. CWT looks forward to
working with the CWCB to complete this donation.

_ S~.

John Camey
Executive Director
