<br />'. <br /> <br />'. <br /> <br />.' rights, or interests in water to preserve or improve the natural environment. The new rules require a <br />minimum of two Board meetings for final action. Three meetings are necessary if a hearing is requested. <br />This Board meeting, May 2004, initiates the 120-day time period for the Board to consider the terms <br />and conditions of the Water Trust's proposal. Final action on the proposal could occur at either the July <br />or September 2004 Board meeting. <br /> <br />The Rules also require the Board to evaluate the "appropriateness" of the acquisition and determine <br />how best to utilize the acquired water rights to preserve or improve the natural environment. In determining <br />how best to utilize the acquired water rights, the Board may elect to combine or "stack" the acquired rights <br />with any other instream flow appropriation, pursuant to Rule 6c, to preserve or improve the natural <br />environment. If the Board elects to combine or stack the acquired water rights, the details of how the rights <br />are to be combined must be set forth in the change application for the acquired right. <br /> <br />The enclosed Preliminary Report contains additional technical information about the water <br />rights, instream flow needs, and other factors for the Board to consider in reviewing the proposed <br />acquisition. <br /> <br />Staff has requested recommendations from the Division of Wildlife, the Division of Parks and <br />Outdoor Recreation, the U,S.Department of Agriculture and the U.S. Department of Interior, pursuant to <br />statute, Staff has also provided notice of the proposed acquisition to all persons included on the appropriate <br />ISF Subscription Mailing Lists pursuant to Rule 6i of the ISF Rules, <br /> <br />Staff Recommendation <br /> <br />. Pursuant to ISF Rule 6b, the day the Board considers this memo will initiate the 120-day period for <br />Board review. No formal action is required at this time. The Board's action will occur at a subsequent <br />meeting, At that meeting, the Board will decide <br /> <br />. How to utilize the acquired water rights on each stream segment; <br /> <br />. Whether the proposed acquisition of water rights is appropriate to preserve or <br />improve the natural environment; and, <br /> <br />.
