<br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 7a(8) <br />Case No. 5-93CWI74; Blue River Valley Ranch Associates <br /> <br />Case Summarv <br /> <br />The Board ratified the statement of opposition filed in this case at its November 1993 meeting. <br />Applicant is proposing to change a 2 acre-foot, conditional storage water right to a I cfs, direct <br />flow water right on a tributary to the Blue River near Silverthorne in Summit County (see <br />attached map). <br /> <br />Stipulation <br /> <br />Applicant has agreed to the following terms and conditions which will provide 100% protection <br />for the Board's instream flow water right on the Blue River: <br /> <br />. To ensure that the change from a storage right to a direct flow right in the Blue <br />River, Applicant agrees to: <br /> <br />I) Divert the direct flow water right at the same point of diversion as <br />originally contemplated for the conditional storage right; <br /> <br />2) <br /> <br />Irrigate the same lands as originally contemplated under the conditional <br />storage right; <br /> <br />3) Limit total annual diversions to 2.0 acre-feet as per the conditional storage <br />decree; and <br /> <br />4) Limit maximum instantaneous diversions to 1.0 cfs. <br /> <br />. Applicant shall install such measuring devices as may be reasonably required by <br />the Division Engineer or a designated agent thereof to adequately administer these <br />rights. <br />
