<br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 7a(6) <br />Case No. 5-92CW295; Upper Eagle Regional Authority & Edwards <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its March 1993 meeting. <br />Applicant is requesting a change of water right and approval of a plan for augmentation on the <br />Eagle River near the Town of Avon in Ea.gle County (see attached map). Applicants propose to <br />include Cottonwood PUD within the boundaries of Edwards Metropolitan District. Applicants' <br />plan for augmentation contemplates releases of water stored in Green Mountain Reservoir to <br />replace out-of-priority depletions to the Eagle River. <br /> <br />Stipulation <br /> <br />Applicant has agreed to the following terms and conditions which will provide 100% protection <br />for the Board's instream flow water rights on the Eagle River. <br /> <br />. <br /> <br />Applicants' agree to discontinue the use of Green Mountain Reservoir as an <br />augmentation source at any time the State Engineer determines that streamflow in <br />the Eagle River is less than the amounts decreed to the Board and would either (1) <br />provide replacement releases from inbasin storage facilities which are suitable to <br />the State Engineer and which will fully replace Applicants' diversions to <br />Cottonwood PUD at or above the point or points of diversion or (2) curtail <br />diversion to the Cottonwood PUD. <br /> <br />. Edwards Metro District previously entered into a stipulation with the Board <br />relating to instream flow appropriations in the Eagle River in Case No. 85CW610. <br />By entry of a decree in this case those commitments 'made to the Board are not <br />altered in any respect nor does the operation of this plan alter the conditions of <br />approval contained in the previous decree of augmentation described hereinabove. <br />
