<br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 7a(4) <br />Case No. 5-92CWI94; Benedict <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its January 1993 meeting. <br />Applicant is requesting a change of water rights on Hunter Creek near the town of Aspen in <br />Pitkin County (see attached map). Applicant is proposing an alternate point of diversion for two <br />senior irrigation rights and a change in type and place of use. <br /> <br />The Board holds several in stream flow rights on Hunter Creek (including donated water rights) <br />which could be injured by this change of water right. Applicant's proposed change of place of <br />use and request for alternate points of diversion may result in an expansion of use. <br /> <br />, Stipulation <br /> <br />Applicant has agreed to the following terms and conditions which will provide 100% protection <br />for the Board's instream flow water right on Hunter Creek. <br /> <br />. Applicant agrees to dry up 5.8 acres of irrigated land; <br /> <br />. <br /> <br />Applicant agrees to limit diversions to the water that is physically and legally <br />available during the annual irrigation season at the original point of diversion; <br /> <br />. <br /> <br />Applicant also agrees to limit diversions to irrigation of 5.8 acres of pasture land. <br /> <br />File = C:\wp51\board.man\stp\592cwl94.stp <br />
