<br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 7a(3) <br />Case No. 2-93CW072; Werbner <br /> <br />Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its March 1994 meeting. <br />Applicant is requesting a junior storage right and approval of a plan for augmentation on Echo <br />Creek and Lake Creek near the Town of Leadville in Lake County (see attached map). <br />Applicant is proposing to augment the out-of-priority depletions from the pond with releases of <br />stored water from Twin Lakes Reservoir. <br /> <br />The Board holds instream flow rights on Echo and Lake Creeks which could be injured by this <br />plan of augmentation. Applicant's augmentation plan may not replace depletions in the same <br />amount, timing, or location at which they occur. <br /> <br />Stipulation <br /> <br />Applicant has agreed to refrain from diverting water from Echo Creek into Echo Pond at any <br />time such diversion would cause the flow in Echo Creek to fall below 2 cfs which will provide <br />for 100% protection for the Board's in stream flow rights on Echo Creek and Lake Creek. <br /> <br />File = C:\wp51lboonl.mem"lpl293cw072..lp <br />
