<br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Item 7a(l) <br />Case No. 1-92CWI56; City of Aurora <br /> <br />.Case Summary <br /> <br />The Board ratified the statement of opposition filed in this case at its March 1993 meeting. Applicant <br />is requesting a change of water rights on Jefferson, Michigan, and Tanyall Creeks near the town of <br />Jefferson in Park County (see attached map). Applicant proposes to dry up lands historically irrigated <br />on the Johnson Ranch along Jefferson Creek and divert the 525 AF of historic consumptive use <br />upstream at Jefferson Lake, Como Reservoir, and Columbine Reservoir, or at other downstream <br />locations. Applicant also is also proposing that the type of use be changed from irrigation to year- <br />round municipal and domestic purposes. <br /> <br />The proposed upstream storage of consumptive use credits in Jefferson Lake, Como and Columbine <br />Reservoirs may deplete segments of the Board's instream flow rights on Jefferson, Michigan, and <br />Tarryall Creeks which have not historically been depleted by these senior rights. In addition, the <br />proposed change may result in a loss of return flows on these streams. <br /> <br />Stipulation <br /> <br />Applicant has agreed to the following terms and conditions which will provide 100% protection for <br />the Board's instream flow water rights on Jefferson, Michigan, and Tarryall Creeks: <br /> <br />. Applicant has agreed to make releases from Jefferson Lake during the winter months <br />(August 1 through April 30) to reproduce the historic return flow patterns associated <br />with irrigation on the Steiner Ranch. <br /> <br />. Applicant has agreed that it will not store water or exchange water into either the <br />Como Reservoir or Columbine Reservoir facilities unless the CWCB's instream flow <br />rights are satisfied on Michigan and Tarryall Creeks. <br /> <br />. Applicant has agreed to install a gage on Tarryall Creek to administer the <br />provisions of the stipulation prior to any operations using either Como or <br />Columbine Reservoirs. <br /> <br />1-92CWlS6.RES <br />
