<br />e <br /> <br />Case No. 93CW124/Head et 01. <br />Findings of Fact, Conclusions of Law, <br />Judgment and Decree <br />Page 2 <br /> <br />The water rights awarded in C.A. 1127 are hereby affirmed by the <br />Court with respect to the above named Applicants and all persons <br />claiming under said decree, and are set forth below: <br /> <br />A. <br /> <br />Decreed <br />souqht: <br /> <br />name of structure for which <br />Beaver Creek stockwater. <br /> <br />water <br /> <br />riqht <br /> <br />is <br /> <br />B. Source: Beaver Creek, a tributary of the Colorado River. <br /> <br />1) Date of appropriation: September 5, 1885. <br /> <br />2) How appropriation was initiated: By diversion of <br />stockwater by livestock directly from the stream <br />bed throughout the year for the watering of all <br />types of livestock and, including, all types of <br />wildlife. <br /> <br />3) <br /> <br />Date water applied to beneficial use: September 5, <br />1885. <br /> <br />e <br /> <br />C. Leqal description of water riqht: The stockwater which <br />is the subject of this application will be diverted <br />directly from Beaver Creek between the point of diversion <br />.of the City of Rifle diversion structure in the NW~SE~ of <br />Section 36, Township 6 South, Range 94 West of the 6th <br />P.M. at a point whence the SE corner of said Section 36 <br />bears S. 49028' E. 2,209 feet to the original headgate of <br />the Claussen Ditch located in the NE~ of the NW~ of <br />Section 26, Township 6 South, Range 94 west of the 6th <br />P.M. at a point whence the NE corner of Section 26 bears <br />N. 81005' E. 3,230 feet. <br /> <br />D. Amount: 0.10 c.f.s., measured at the City of Rifle's <br />Beaver Creek headgate, along with an additional 0.10 <br />c.f.s., or a total bypass of one-half of the stream flow <br />in Beaver Creek, whichever is less, for a period of <br />twenty-five (25) days from November 15 through February <br />28. <br /> <br />E. Use: Livestock and wildlife watering directly from <br />Beaver Creek. <br /> <br />STIPULATIONS <br /> <br />e <br /> <br />7. <br /> <br />The foregoing Findings of Fact are fully incorporated herein. <br />
