e

e

e

Agenda Item 4b
Case No. 4-94CWI4 I; Lake City Ranches, LTD.

Application Summary

This is an application for a change of water rights on the Lake Fork Gunnison River near the town
of Lake City in Hinsdale County (see attached map). Applicant is requesting to change the present
decreed point of diversion for the B&B Ditch to a point approximately 800 feet downstream which
is described in the application as the "actual historic location" of the ditch. Applicant is also
requesting an upstream alternate point of diversion for the Baker No.2 and Baker East Side Ditch
at the proposed location for the B&B Ditch. Additional uses for the B&B Ditch will include
recreation, fish, stock, wildlife and the filling of Baker Reservoir No.3.

CWCB Aooropriations

The Board holds an instream flow decree for 45 cfs, summer, and 25 cfs, winter, on the Lake Fork
Gunnison River with an appropriation date of March 17, 1980, which could be injured by this
application.

Potential for Iniury

Applicant's proposed change of its senior water rights to upstream points of diversion has the
potential to deplete the Board's instream flow rights on the Lake Fork Gunnison River.

Other Obiectors

There are no other objectors in this case. However, at the time this memo was prepared, the period
for filing statements of opposition to this application had not yet expired.

494CW141.S0P
