<br />, <br /> <br />--' <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />Agenda Itern 20b <br />Septernber 12, 1991 <br /> <br />Discussion <br /> <br />The Booth Pump and Pipeline alternate point of diversion will be used to rnore <br />efficiently irrigate the same parcel of land as historically irrigated by the Ferguson Ditch <br />right. The Phillips Ditch alternate point will be used to irrigate a second parcel of land. <br />The staff believes the proposed stipulation adequately protects the Board's rights in this case <br />because: <br /> <br />1) Streamf10ws in Gypsum Creek upstream of the proposed alternate points of diversion <br />will be enhanced by tI1e downstream movement of tI1e Ferguson Ditch water right. <br /> <br />2) Historically, tI1e use of tI1e Ferguson Ditch water right was 100% consurnptive to <br />Gypsum Creek. By holding tI1e applicant to the historic irrigation season and the <br />quantity of water physically and legally available at tI1e original headgate, the depletion <br />to Gypsurn Creek cannot be expanded. <br /> <br />3) Gypsum Creek may benefit frorn return flows downstream of the lands irrigated by <br />the Phillips Ditch. <br /> <br />Staff Recornrnendation <br /> <br />The staff recommends that tI1e Board ratify tI1e attached stipulation with Mr. Goldsmith. <br /> <br />DCM/GDE/gl <br />Attachments <br /> <br />590CW2S0.stp <br /> <br />-2- <br /> <br />. <br />
