Walker <br />Director <br /> <br />FROM: Dan Merrirnan <br /> <br />DATE: September 12, 1991 <br /> <br />SUBJECf: Agenda Item 19c, September 19-20, 1991, Board Meeting-- <br />Statements of Opposition: Instream Flow Program <br />Case No. 5-91CW073; Devil's Thumb Joint Venture <br /> <br />Application Summary <br /> <br />The applicant requests a change of water right on the Fraser River near the town of <br />Tabernash in Grand County (see attached map). The applicant proposes to change the <br />place of storage of a 4.5 AF senior conditional water right upstrearn approxirnately 1500 feet <br />to an existing pond. Applicant's decreed source of water is surface runoff, seepage and <br />natural drainage. Applicant is requesting an alternate point of diversion on the Fraser River <br />to fill the off-channel pond. <br /> <br />CWCB Appropriations <br /> <br />The Board has an instream flow appropriation on the Fraser. River for 17 cfs, <br />summer, and 11 cfs, winter, with an appropriation date of November 27, 1990, which could <br />be injured by this application. <br /> <br />Potential for Iniury <br /> <br />Approximately 1500 feet of the Fraser River, which supports an adult population <br />of brown and rainbow trout, could be depleted by diversions at the proposed alternate point. <br /> <br />Other Objectors <br /> <br />There are no other objectors in this case. <br />
